DESPITE TRUMP’S DISCLAIMERS, HIS PROJECT 2025 WILL GUT ABORTION ACCESS FOR ALL AMERICANS

QUICK READ: Spooked by voters’ negative reactions to Trump’s Project 2025 reproductive rights agenda, Trump is desperately trying to appear moderate. We must not be fooled, however, because Project 2025 is relying on the Reconstruction-era Comstock Act to to effectively outlaw abortion nationwide without Congressional action. Congress must repeal it immediately.

BACKGROUND

As voters learn about Trump’s Project 2025, their alarm grows about its possible implementation. Voters correctly believe Trump wants abortions outlawed in all or most cases and fear Project 2025’s calls for a national abortion ban and the monitoring of pregnancies for possible prosecution after miscarriages.

Having failed to distance himself from Project 2025 and its attacks on reproductive freedom, he’s now desperately trying to appear moderate, despite repeatedly bragging about how, through his judicial appointments, he overturned Roe: 

Such promises are meaningless because Project 2025 describes how, by executive order on Day 1, he can use the Reconstruction-era Comstock Act to halt medication abortion via telehealth and mail, effectively banning abortion everywhere without Congressional action [pp.455-62]. He could then instruct his Attorney General to prosecute the providers and distributors of medication abortion and abortion-related materials and even those who create and ship the materials commonly used in surgical abortions.

These policies’ consequences are devastating:

  • Women who’ve aborted, or even had miscarriages, can be prosecuted;

  • Without telehealth and mail medication abortion more women will die or needlessly suffer grave health consequences;

  • Fearing criminalization, providers will delay or deny care, and the subsequent dearth of 

  •  maternity-care professionals will further eradicate access to basic care for entire families and communities.
