QUICK READ: Ironically, at the same time we’re preparing to celebrate our democracy, the Trump-created, corrupt, ethically challenged, anti-democratic, MAGA supermajority at the Supreme Court is spewing out opinions that mortally wound our government’s ability to operate smoothly and to protect our health, freedoms, and environment by precluding agency experts from creating and enforcing agency policies, that undermine the rule of law by granting Trump absolute immunity for crimes committed while President, and that interfere with the electoral process on Trump’s behalf. We and our Members of Congress must hold this power-grabbing Court accountable. 



CONTENTS:

BACKGROUND

In a democracy, we’re supposed to be ruled by the people and our elected representatives. Instead, a rigged confirmation process and partisan judges with obvious conflicts of interest and sketchy, undisclosed financial entanglements allow SCOTUS’ MAGA supermajority to declare war on our democracy and continue grabbing power and protecting the conservative project: 

  • Mortally wounding our government’s ability to operate smoothly and to protect our health, freedoms, and environment, by gutting agencies’ enforcement abilities and by ruling that federal courts, not experts in administrative agencies, should get the final say on all federal policies; 

  • Undermining the rule of law and rejecting the principle that no one is above the law by granting Trump absolute immunity from prosecution for crimes committed while President;

  • Intruding in the electoral process on Trump’s behalf by holding back that decision until a pre-election trial was impossible. 

Between now and November, our MoCs must:

  • Remind voters elections have consequences and Supreme Court reform is on the ballot; 

  • Speak out about the present and future effects of these disastrous opinions;

  • Push for full-scale investigations of the MAGA Justices’ perversion of the Constitution, misreading of the Bill of Rights, violation of ethical rules, failure to respect precedents, and rewriting of statutory law.

  • Co-sponsor legislation prohibiting judge shopping, imposing Supreme Court term limits and an enforcible ethics’ code, and rebalancing the Court.

And, to protect our democracy, we must do everything in our power to ensure we elect a Democratic Trifecta committed to reforming SCOTUS.
