SCOTUS Is Flouting The Rule of Law. How Ironic.
QUICK READ: In a series of Supreme Court decisions about affirmative action, student loan forgiveness, and LGBTQ discrimination, SCOTUS’ MAGA Supermajority has pushed a personal agenda in defiance of the rule of law, the other branches of government, the Constitution, and expert opinions. We must expand the Court now.

BACKGROUND
The Supreme Court’s MAGA supermajority is speaking with one voice, but not ours.
Immediately following their anti-affirmative action decision, despite the pleadings of experts for diversity in recruiting, they further attacked access to higher education and equality by canceling Biden’s student loan forgiveness program and upholding open discrimination against LGBTQ+people.
In Biden v. Nebraska, they overruled both executive and legislative branches of government by overriding Congress’ unambiguous decision granting the Secretary of Education power to alter student debt during national emergencies. The statute also instructed federal courts explicitly not to “interpret” law or limit the Secretary’s authority. And, by reading words out of context and invoking a fabricated “major questions” doctrine, they violated the Constitution.
In 303 Creative, the same MAGA supermajority “reduced the rule of law to brute force in the service of religious nationalism” when ruling that businesses may refuse to serve LGBTQ people–mking separate but equal the new normal in a case where there was “no victim, no injury, and no case or controversy.”.
In dissent, Justice Kagan wrote: “Battling discrimination is like “battling the Hydra.” Whenever you defeat “one form of . . .discrimination,” another “spr[ings] up in its place.”
