BACKGROUND

This Independence Day, we must acknowledge the rights destroyed by the corrupt, unelected MAGA Justices bought and paid for by right-wing billionaires seeking to return America to the pre-New Deal era.

Last year, overturning precedents and legislating from the bench, they took away rights to reproductive choice; voting access; clean air, land, and water; and safety from gun violence. 

Last week, they’ve rolled back other fundamental rights—rejecting affirmative action in college admissions, favoring religious bigots’ speech over anti-discrimination laws, and torpedoing Biden’s student loan forgiveness plan.

They did so by ignoring the standing requirement and established precedents, misreading the equal protection clause to require colorblindness, manufacturing non-existent facts and a doctrine allowing them to ignore statutory words they disliked, and privileging religious bigots’ expressive speech over equality. 

These decisions’ ripple effects are enormous:

·      The 14th Amendment, intended to grant citizenship to formerly enslaved African Americans, can now hinder their descendants’ mobility;

·      Corporate diversity programs are suspect; 

·      LGBTQ+ people overnight become second-class citizens;

·      Any business with “expressive” services may refuse them to women, Jews, blacks, and other minorities. 

Protecting a future where the freedoms promised by our Constitution are accessible to all Americans requires Congress to immediately rein in this “bought” Court.
