CORRUPT SUPREME COURT JUSTICES MUST RECUSE FROM JAN. 6 CASES

QUICK READ: Corrupt Justices Alito’s and Thomas’ direct ties to the January 6 insurrection create clear actual or perceived conflicts of interest that make them unfit to rule fairly over pending January 6 cases and Trump’s absurd claim of absolute immunity. Their failure to recuse, or be forced to recuse by Chief Justice Roberts, suggests SCOTUS cannot fairly decide these cases and demands immediate action from Congress.

CONTENTS:

BACKGROUND

That SCOTUS’ far-right partisan justices are intent on using their power to institutionalize MAGA extremism was revealed by their antipathy, during oral argument, towards holding Trump accountable for his crimes.

Recent reporting of Justice Alito’s insurrectionist leanings highlights SCOTUS’ illegitimacy

·      Days after January 6, when SCOTUS was deciding whether to hear one of Trump’s appeals, an upside-down flag—used by Trump supporters’ attack on the—flew over his  home.

·      He flew another flag associated with Christian nationalism and the insurrection outside another home in 2023.

Even if his wife raised one, their public display conflicts with his duty of impartiality, requiring

recusal from cases concerning Trump and January 6.

Justice Thomas, whose wife actively sought to overturn the 2020 election, should also recuse.

Had they done so when review was sought, these cases might never have reached the Court, allowing Trump’s insurrection trial to proceed to verdict before the election.

Both Justices, among others, have also accepted luxury travel and gifts from with right-wing operatives bringing or benefitting from cases before the court—another ethical violation needing investigating.

Congress must respond:

·      Push the Chief Justice to force their recusal;

·      Conduct the oversight the Constitution demands;

·      Immediately vote on the languishing SCOTUS ethics reform

As you clearly understand, the Supreme Court is facing a massive legitimacy crisis, both for its devastating rulings rolling back our rights and for highly questionable off-the-bench behavior, such as Justices Alito’s and Thomas’ receipt of lavish gifts from operatives with business before the court, and their direct ties to the January 6 insurrection that both create clear conflicts of interest, making them unfit to rule fairly over pending January 6 cases and Trump’s absurd claim of absolute immunity. Their failure to recuse suggests SCOTUS cannot fairly and impartially decide these cases and demands immediate action from Congress. Please push for an immediate Senate Judiciary Committee investigation of all these forms of misconduct and for immediate passage of the Supreme Court Ethics, Recusal, and Transparency Act (S.359).
