QUICK READ: Through manipulation by Trump and McConnell, SCOTUS now has an ultra-conservative majority which is prepared to overturn precedent recognizing women’s right to control their reproductive choices—and possibly other personal liberties that also emanate from the right to privacy, which is protected by the Fourteenth Amendment. To stop this rogue Supreme Court requires both creation of a federal right to abortion and the Court’s rebalancing to reflect the values and life-experiences of Americans.

BACKGROUND

On Monday, Americans learned of the ultra-conservative majority’s latest abuse of power—its plan to overturn popular settled law and make the US an outlier by completely eradicating women’s right to control their reproductive choices—the first time a constitutionally protected right would be withdrawn. 

Upon its release this summer, 26 states will immediately ban abortions, making governments the arbiter of family planning and women, their doctors and their helpers criminals.

In Roe, this right to control one’s body was found to emanate from the right to privacy, which, while unmentioned in the Constitution, is protected by the Fourteenth Amendment’s Due Process Clause. 

Justice Alito’s rejection of this widely held truth can be used to eliminate other accepted personal liberties—contraception, same-sex and inter-racial marriages, same-sex-couple adoptions, consenting adults’ sex and cohabitation, and LGBTQ rights—which, like abortion, were similarly unmentioned and prohibited in many states until recently. 

The Senate must immediately codify Roe, cajoling Senators Murkowski and Collins to agree to suspend the filibuster for this vote only, if Manchin and Sinema won’t.

To prevent additional damage, SCOTUS must be expanded—which requires Democratic midterm victories. Hopefully, this decision convinces voters how much these midterms matter. So vote.
